Welcome to BookCoverly. By accessing our website, purchasing a license, or using our design studio, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Description of Service

BookCoverly ("the Service") is a web-based design tool dedicated to creating book covers, audiobooks, and promotional graphics. The Service acts as a "Software as a Service" (SaaS) platform, providing tools for layout, typography, and asset manipulation.

Soft Launch & Updates: You acknowledge that the Service is currently in a "Soft Launch" phase. We reserve the right to modify, update, or discontinue features as we improve the platform. We are not liable for any temporary interruptions or changes to the toolset during this development phase.

2. Accounts & Access

2.1. Licensing: BookCoverly operates on a "Paid Access" model. To access the design studio, you must purchase a license.

Founding Member (Lifetime) License: A one-time payment granting you perpetual access to the platform without recurring monthly fees. This license is non-transferable.

2.2. Account Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.

3. Intellectual Property Rights

3.1. Your Designs: You retain 100% ownership of the designs you create within BookCoverly. We claim no intellectual property rights over the book covers, graphics, or text you produce using our Service.

3.2. Our Platform: The BookCoverly interface, code, "Smart Spine" algorithms, templates, and proprietary assets are the intellectual property of BookCoverly and are protected by copyright laws. You may not reverse-engineer, duplicate, or resell the software itself.

4. Third-Party Assets & Stock Media

Our Service integrates with third-party APIs (including but not limited to Pexels, Pixabay to provide image resources.

4.1. Usage Rules:

  • Public Domain (Museum APIs): Images designated as "Public Domain" (CC0) are free to use for commercial and non-commercial purposes without attribution.
  • Stock Photography: Images sourced via Pexels or Pixabay are subject to their respective licenses. Generally, these allow for commercial use (book covers) but prohibit selling the unaltered image file itself.
  • User Responsibility: It is your sole responsibility to verify the licensing rights of any image you use. BookCoverly is not liable for copyright infringement resulting from your misuse of third-party assets.

5. Exports & Printing Liability

BookCoverly provides tools (such as the Spine Calculator and Bleed Guides) to assist in creating print-ready files. However, you are the final publisher.

  • No Guarantee: We do not guarantee that every file will be accepted by third-party printers (Amazon KDP, IngramSpark) without error. Printing requirements change frequently.
  • Verification: You are responsible for proofing your final PDF export, checking spellings, and verifying dimensions before submitting to a printer.
  • Limitation: We are not liable for any printing costs, re-stocking fees, or lost revenue resulting from errors in your design file.

6. Refunds & Cancellation

6.1. Refund Policy: Due to the digital nature of this software, refunds are not issued based on general dissatisfaction, change of mind, or statements such as "the app did not meet expectations" or "was not as described."

However, if you experience a legitimate technical issue that prevents core functionality, we are committed to resolving it.

To be eligible for a refund related to a technical issue, you must:

  • Identify the Issue: Clearly describe the specific bug, error, or malfunction preventing proper use of the software.
  • Allow for Resolution: Provide our support team a reasonable opportunity (typically 5–7 business days) to diagnose and resolve the issue.

If we are unable to resolve a verified technical issue within a reasonable timeframe, a refund may be issued at our discretion.

6.2. Termination: We reserve the right to suspend or terminate access to the Service without refund if you violate these Terms, including but not limited to:

  • Attempting to bypass payment systems
  • Using the Service for illegal or prohibited content
  • Attempting to interfere with, hack, or disrupt the platform

7. User Data & Saving

During our Soft Launch phase, we implement rigorous data protection. However, as with all cloud software, data loss is a remote possibility.

  • Save Your Work: You are responsible for saving your project frequently.
  • Backups: We recommend exporting a copy of your work to your local device regularly. We are not liable for the loss of unsaved design data or project files.

8. Limitation of Liability

To the fullest extent permitted by law, BookCoverly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the email address associated with your account. Your continued use of the Service constitutes acceptance of the new Terms.
